Know Your Rights: What to Do If ICE Visits Your Business
While each situation is unique, there are general best practices that employers should follow if ICE agents arrive at your workplace:
🔹 Public Areas: ICE agents can enter public areas of a business, but they do not have the authority to stop, question, or detain individuals without cause. Employees in public spaces have the right to remain silent and request an attorney.
🔹 Private Areas: ICE agents cannot enter private areas of your business without a judicial warrant signed by a judge. Administrative warrants (such as DHS Forms I-200 or I-205) do not grant ICE access to private areas.
🔹 During a Search: If ICE has a valid search warrant, monitor agents closely to ensure they stay within the scope of the warrant. Do not voluntarily provide access to records beyond what is legally required.
🔹 I-9 Audits: If notified of a Form I-9 audit, contact legal counsel immediately. Employers typically have three business days to provide I-9 forms. If ICE identifies unauthorized employees, businesses have 10 days to correct documentation or remove affected employees from payroll.

Supporting Employees with Know Your Rights Training
With enforcement actions making headlines, many workers fear workplace raids or unexpected detentions. Employers should consider providing Know Your Rights training so employees understand their protections under U.S. law, including:
✔ The right to remain silent – Employees are not required to answer questions about their immigration status.
✔ The right to refuse a search – ICE agents must have a valid warrant to conduct a workplace search.
✔ The importance of staying calm – Employees should avoid sudden movements or fleeing, as this could escalate the situation.

A Legacy of Leadership
Joseph’s journey with EXPO Gardens began in 1992, back then it was known as Parks and Patio, when the late Anne Muscat introduced him to the Texas Nursery & Landscape Association (TNLA) and encouraged him to take part in the initiative. Since then, he has led efforts to:

✅ Curate donation lists for plants and materials
✅ Coordinate on-site installations with industry partners
✅ Enhance key areas of EXPO, including TNLA’s booth, the PAC lounge, and education spaces

His eye for detail and deep understanding of horticulture have helped elevate EXPO year after year, creating a welcoming atmosphere for both exhibitors and attendees.

A Passion for Public Gardens
Beyond EXPO, Joseph has built an impressive career in public horticulture. A Texas A&M horticulture graduate (’88), he has held leadership roles at the Dallas Arboretum and MD Anderson Cancer Center. In 2016, he returned to Texas A&M to lead the Leach Teaching Gardens, a 7-acre outdoor classroom and community space that educates and inspires future horticulture professionals.

Legislative Efforts: A Game-Changer
​State lawmakers, led by Senator Charles Perry, are making this legislative session pivotal for water policy. Perry, chair of the Senate Water and Agricultural Resources Committee, proposes allocating at least $1 billion annually to the Texas Water Fund. This funding could support critical projects like infrastructure maintenance, desalination, and drought mitigation.

Hostile foreign ownership of agricultural land is emerging as a significant issue for the 89th Texas Legislative Session. Nationwide, 25 states have already enacted laws restricting foreign ownership of land, with Texas now considering its own measures. The primary concerns revolve around land acquisitions by individuals or entities linked to China, Iran, North Korea, and Russia, particularly near U.S. military bases.

According to the American Farm Bureau Federation, foreign investors from Canada, the Netherlands, Sweden, and Germany collectively own approximately 50% of Texas agricultural land held by non-U.S. entities. While much of the focus has been on countries considered hostile to the U.S., this broader context underscores the complexity of foreign land ownership in Texas

During the 2023 Texas Legislative Session, the Texas Senate passed Senate Bill 147 (SB 147), authored by State Senator Lois Kolkhorst (R-Brenham). The bill sought to prohibit property acquisition by governmental entities from China, Iran, North Korea, and Russia. It specifically targeted agricultural land, timberland, and property near military bases to mitigate potential security risks. SB 147 included definitions, exceptions for diplomatic and consular properties, and provisions allowing current landowners from these countries to retain their property while restricting future acquisitions.

In presenting SB 147, Senator Kolkhorst cited examples such as the purchase of 130,000 acres near Laughlin Air Force Base in Del Rio by a former member of the Chinese People’s Liberation Army. She emphasized concerns about national security and pointed out the double standard in which Americans cannot purchase land near Chinese military bases. Kolkhorst argued that similar restrictions should apply in Texas.

As the 89th Legislative Session unfolds, several bills addressing foreign land ownership have been introduced. While some focus specifically on agricultural land, others take a broader approach to foreign ownership of Texas property. Most proposals center on limiting acquisitions by companies tied to the governments of China, Iran, North Korea, or Russia, or entities with significant ownership from these nations.
Current Legislative Proposals:

• SB 103 by Senator Bob Hall (R-Edgewood)
• SB 307 by Senator Lois Kolkhorst (R-Brenham)
• HB 191 and HB 1566 by Representatives David Spiller (R-Jacksboro) and Jared Patterson (R-Frisco), respectively (identical bills)
• HB 518 by Representative Terri Leo-Wilson (R-Galveston), a broader bill banning all nonresident or foreign acquisition of agricultural land
• HB 1743 by Representative Mitch Little (R-Carrollton), targeting countries under U.S. arms embargoes, including Afghanistan, the Central African Republic, Cyprus, the Democratic Republic of Congo, Eritrea, Ethiopia, Haiti, Iraq, Lebanon, Libya, Nicaragua, Russia, Somalia, South Sudan, Sudan, and Zimbabwe

This issue reflects a growing concern among lawmakers and Texans about the strategic and security implications of foreign ownership of land in the state.

2024 Legislative Session: Over 2,200 Bills Filed
The upcoming legislative session begins on January 14, 2024, with over 2,200 bills and resolutions already filed. The race for the next Speaker of the Texas House remains undecided, an unusual development that adds uncertainty to committee leadership assignments.
The Speaker of the House plays a critical role in shaping which legislators will lead committees most important to the Green Industry, including:

• Agriculture and Livestock
• Natural Resources
• Environmental Regulations
• Ways and Means

Typically, the Speaker race is resolved well before the session starts. However, it appears we might not know the winner until the election takes place on the first day of the session, immediately after members are sworn in at noon. Until a Speaker is elected, no substantive business can occur, making the outcome of this vote vital to the legislative agenda and our industry’s priorities.

Farm Bill Extended
Congress recently passed a Continuing Resolution (CR) to fund the government through March 14, 2024, which includes a one-year extension of the 2018 Farm Bill. The CR also provides $30.78 billion for disaster aid and economic assistance to farmers impacted by droughts, wildfires, hurricanes, and other natural disasters in 2023 and 2024.
Key allocations include:

• Up to $2 billion to support livestock producers.
• $10 billion for general economic relief.

Additionally, the resolution grants the Secretary of Agriculture the authority to issue block grants for farmers affected by Mexico’s failure to meet water delivery obligations under the 1944 Water Treaty (including Texas farmers along the Rio Grande).
Looking ahead, agricultural leaders are emphasizing the critical need for a modernized Farm Bill in 2025 to provide long-term stability and improved risk management for rural America. This legislation will be pivotal for our industry as we navigate workforce and resource challenges.

Debate Over H-1B Visas Heats Up During the Holidays
A spirited debate over high-skilled immigration policies, particularly the H-1B visa program, recently took center stage within the Republican Party on Twitter. Tech leaders, such as Elon Musk and Vivek Ramaswamy, have advocated for easing restrictions to boost economic competitiveness, while MAGA-aligned conservatives have pushed for stricter immigration policies. This clash highlights broader questions about high-skilled immigration’s role in America’s economy and cultural identity.

For the nursery and landscape industry, these discussions are highly relevant, as they may signal future changes to programs like H-2A and H-2B, which are essential for meeting seasonal labor needs. Although the impact of this debate on these programs is still uncertain, TNLA will closely monitor the situation and continue advocating for policies that address our industry's workforce requirements.
